For all orders placed on our website, you accept the general terms and conditions of sale described below.

Preamble

This document (hereinafter referred to as the "Contract") sets out the general terms and conditions of sale applicable between :

  • Dioxyjen Graphic, hereinafter referred to as "Resilience Skill", "We", "Us", "Our" or the "Seller", a French limited liability company (Entreprise Unipersonnelle à Responsabilité Limitée) with a share capital of 1000 euros, whose registered office is located at 3 le Recredy 85170 Bellevigny, France, registered in the La Roche-sur-Yon trade register under number B 834 339 871, whose intra-community VAT number is FR03834339871, represented by Mrs Jennifer VIAL in her capacity as manager.
  • And the User, hereinafter referred to as "You", "Your" or the "Customer(s)", any non-trading natural person residing in the territory mentioned in article 1.3 below, wishing to make, making or having made a purchase (hereinafter the "Order(s)") on a strictly personal basis and without any commercial, associative or professional purpose, nor of resale or transfer for payment or free of charge, of a product or service marketed by the Vendor on the www.resilience-skill.fr site.

The Parties agree that their relationship shall be exclusively governed by this Agreement, to the exclusion of any other terms and conditions previously available on the site.

Article 1: Application of the Conditions

These general terms and conditions of use (hereinafter referred to as "GTCU") govern your use of the website [www.resilience-skill.fr] and your purchases made thereon. By accessing, browsing or using this site in any way whatsoever, you acknowledge that you have read, understood and unreservedly accept these terms and conditions.

Article 2: Validity of Offers

The offers presented by Dioxyjen Graphic are intended for consumers with a delivery address in metropolitan France, Europe and the French overseas departments and territories. The items shown on the site are available while stocks last. In the event of an order for an unavailable item, Dioxyjen Graphic undertakes to inform the Customer and to offer him a credit note or a full refund within a maximum period of fifteen (15) working days. Dioxyjen Graphic reserves the right to withdraw or modify at any time the offers available on the site without prior notice.

Product offers and prices are valid as long as they are visible on the site, while stocks last. In the event of product unavailability after the order has been placed, the customer will be informed by email. The order will be automatically cancelled and no bank debit will be made.

Article 3: Presentation of the Products

Dioxyjen Graphic takes the greatest care in the presentation and description of its products in order to provide the best possible information to the Customer. Nevertheless, Dioxyjen Graphic cannot be held responsible for any errors or omissions in this presentation. Product images are provided for illustrative purposes only, and delivered products may sometimes differ from these images.

Article 4: Product prices

Product prices are quoted in euros (€), inclusive of all taxes, and include the VAT applicable on the day the order is placed. Any change in the applicable VAT rate may be reflected in the prices of products and services after the date of the change. Prices may be modified at any time, without prior notice, but modifications will not be applicable to orders that the Customer has already validated.

Article 5: Details of Additional Charges

Taxes: All product prices on the site include applicable VAT. Any change in the applicable rate may affect product prices without notice.

Customs and import duties: For deliveries outside the European Union, customs and import duties may be required, depending on the legislation of the destination country. These charges are payable by the customer.

Delivery costs: Delivery costs are calculated according to the order and will be indicated before the final validation of the order.

Article 6: Ordering and payment

6.1- REGISTRATION, ORDERING AND PAYMENT

Customers interested in an item displayed on the www.resilience-skill.fr website follow the steps below to place their order. After clicking on the "confirm" icon and checking the specifics of the order (reference, quantity, size, price, etc.), the customer validates the choice of product(s) selected by clicking. If the customer benefits from a special offer, he/she must first enter a promotional code that has been allocated to him/her in the field provided for this purpose. When placing their first order, customers are asked to fill in a form containing the following information: title, surname, first name, full delivery address, e-mail address, date of birth and telephone number. On this occasion, the customer creates a password. The customer can pay by credit card directly on the site.

Once the order has been validated, the customer will receive an e-mail confirming payment. When the order is dispatched, an electronic invoice will be sent to the e-mail address entered when filling in the form. It is important to enter a valid e-mail address when ordering. We recommend that you save this e-mail address for future reference. The order confirmation (receipt) also constitutes a guarantee and proof of purchase.

6.2- DEFAULT OF PAYMENT

Dioxyjen Graphic reserves the right to refuse to make a delivery or to honour an order from a consumer who has not fully or partially settled a previous order or with whom a payment dispute is being administered.

6.3- PAYMENT VERIFICATION

Dioxyjen Graphic checks all orders validated on its site. The purpose of these checks is to protect the company from abusive practices by fraudsters. Dioxyjen Graphic may ask you to provide all the necessary documents to release your order: proof of address or debit in your name, or proof of address in the name of the person indicated for the delivery address, etc...

Article 7: Payment security

To ensure the security of online payments, Dioxyjen Graphic uses the CIC bank's Monetico secure online payment service. This service integrates the SSL and 3D Secure security standards. Confidential data (16-digit credit card number, expiry date and CVV code) are transmitted encrypted directly to the bank's server, without passing through the server's physical media. Dioxyjen Graphic does not process credit card numbers. When the order is validated: the payment request is routed in real time to the secure remote payment manager. This sends an authorization request to the credit card network. The telepayment manager issues an electronic certificate which serves as proof of the amount and date of the transaction, in accordance with the provisions of articles 1316 et seq. of the French Civil Code.

Dioxyjen Graphic does not charge any additional fees for credit card payments.

Article 8: Deliveries

Dioxyjen Graphic ships its products to Metropolitan France, French overseas departments and territories and certain European countries.

The delivery times indicated at the time of order are indicative notwithstanding any fortuitous event or force majeure which would delay delivery independently of the will and diligence of Dioxyjen Graphic (customs, carrier delay, weather...). Dioxyjen Graphic makes every effort to ensure that your parcel arrives on time, but the delivery date is not guaranteed.

CUSTOMS DUTIES

Please note that for orders shipped outside the EU and to French overseas departments and territories, import duties and taxes may apply and are collected at the time of delivery to the shipping address. You will be responsible for payment of any such import duties and taxes. Please be aware that Dioxyjen Graphic has no control over these charges and, as they vary from country to country, cannot know the amount. Dioxyjen Graphic advises you to contact your local customs office for further information before confirming your order.

HANDLING UNDELIVERED PARCELS

These are packages that have not been delivered to the final recipient for the following reasons: NPAI, unclaimed, refused, transport damage, spoliation... Dioxyjen Graphic will contact the customer in order to return the order (postage at the customer's expense) if the product is still available, or to proceed with the reimbursement of the order according to the customer's wishes.

Article 9 : Right of withdrawal and returns

CANCELLATION BY THE CUSTOMER

The individual customer has a right of withdrawal, which he may exercise without giving any reason, within fifteen (30) clear days from receipt of the product(s) ordered, the day of receipt being the 1st day.

As a customer, if you feel that the delivery of your order is so late that you no longer wish to complete it, it is your responsibility to cancel it. In cases where the order has been shipped, the customer is obliged to receive it. Cancellation is not valid until the customer has confirmed it to Resilience Skill by written notification (email).

PRODUCT(S) RETURN

The cancellation of your order will be effective provided that you scrupulously respect the following procedure:

You must, within 30 days of receiving your order, contact customer service via our contact form available on the website and indicate the reasons for your cancellation as well as the products concerned, the order number and your contact details.
Pack the products concerned, taking care to ensure that they are in the same condition as when you received them (unworn, unwashed and still labelled in their original packaging).
Dioxyjen Graphic cannot be held responsible for the loss of one or more items during the return shipment.
Upon receipt of the product(s) concerned, Dioxyjen Graphic will reimburse the customer for the amount already paid when the order was placed online, less shipping costs. Refunds of products will be made by Dioxyjen Graphic within a maximum of 15 days of receipt of said products. Refunds will be made by the same method of payment chosen by the customer at the time of ordering, or by the issue of a voucher.

Article 10: Right to reject or cancel the order

CANCELLATION BY THE SELLER

All orders placed on the www.resilience-skill.fr website are subject to product availability. We expressly reserve the right to refuse your order for any reason whatsoever. We also reserve the right to cancel a contract by written notice, without being liable for any damages or costs other than the refund of any sums paid by you in connection with the order we have cancelled in the following situations:

  • the product is not available / in stock ;
  • your billing information is incorrect or unverifiable;
  • your order is flagged by our security systems as an unusual order or an order susceptible to fraud
  • you are showing bad faith;
  • you are a retailer;
  • there was an error in the price displayed on the site;
  • we were unable to deliver to the address you provided;
  • due to an Event beyond our control (*)
FORCE MAJEURE (*)

An Event "Beyond Our Control" means any act or event beyond our reasonable control, including but not limited to strikes, industrial disputes or any other collective action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster or failure of public or private telecommunications networks. If an Event Beyond Our Control occurs and affects the performance of our obligations under these terms and conditions of sale:

a) We will contact you as soon as possible to inform you; and
b) Our obligations under these terms and conditions will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control.

If the Event Outside Our Control affects the delivery of a product, a new delivery date will be established with you after the Event Outside Our Control has ended. You may cancel the contract if an Event Outside Our Control occurs and you no longer wish us to deliver the products to you. Please note your cancellation rights in the Order Cancellation / Returns section.

Article 11: Responsibilities

For all stages of access to the site, consultation, filling in forms, placing orders, delivery of articles or any other service, the company Dioxyjen Graphic has only an obligation of means. Consequently, Dioxyjen Graphic cannot be held liable for any inconvenience or damage inherent in the use of the Internet network and totally external to the diligence and precautions taken by Dioxyjen Graphic. In particular, Dioxyjen Graphic cannot be held responsible for any disruption in the supply of the service, or any external intrusion or presence of a computer virus. Similarly, any event qualified as force majeure within the meaning of the jurisprudence of the Cour de Cassation (French Supreme Court) totally exonerates Dioxyjen Graphic from any liability. Customers benefit from the guarantees granted by the brands present on the site.

Article 12: Incapacity for work

In the event of incapacity to work, due to illness or accident, Dioxyjen Graphic reserves the right to modify the processing time for orders in progress, without the Customer being entitled to claim compensation.

Article 13: Retention of title

All products remain the property of Dioxyjen Graphic until they have been paid for in full.

Article 14: Applicable law and jurisdiction

These terms and conditions and your use of the www.resilience-skill.fr website are governed by French law. To the extent permitted by law, the French courts shall have exclusive jurisdiction over any dispute arising out of these terms and conditions and your use of the website, subject to Dioxyjen Graphic's right to bring proceedings against a user in his place of residence.

Article 15: Modification rights

Dioxyjen Graphic reserves the right to revise these terms and conditions from time to time. Whenever you order a product from us, the terms and conditions in force at the time of your order will govern the contract between you and Dioxyjen Graphic. We therefore recommend that you consult this page regularly and take note of the current terms and conditions to which you are bound.
